Personal Injury: Funding

In the vast majority of cases we are able to act for clients on the basis of a Conditional Fee Agreement. This is commonly known as a “No Win No Fee” Agreement. Essentially this means that you do not have to pay us anything if your claim is unsuccessful. If your claim is successful then we can recover our costs and expenses from the other side and you do not have to pay for legal costs. We will therefore act on your behalf at no cost to you.

You may be aware that in the past "No Win No Fee" Agreements have been the subject of bad publicity and that in some cases the compensation recovered has all been used to pay for legal costs. This does not apply to us and we guarantee that if you start a new claim with us then you will receive 100% of your damages and we will not make any deductions from your compensation to pay for legal costs.

In most cases we are successful in recovering compensation on behalf of clients. However, on rare occasions, a claimant may be unsuccessful on going to Court. If this happens then the claimant may become liable to pay the other side’s legal costs. In order to ensure that you as the claimant never have to pay the other side’s costs we will arrange for an insurance policy to be taken out on your behalf. This will pay for the other side’s costs in the unlikely event of the claim being unsuccessful, so that you do not have to pay anything. We are usually able to arrange insurance policies at no cost to you.

Provided that you are honest about the circumstances of your accident and cooperate with us by providing information when we ask you to do so, then we will never ask you to pay our costs. In rare cases, clients may lie to us about the circumstances of their accident or fail to respond to repeated telephone calls and letters which means that we have to abandon the claim. In these circumstances, we do reserve the right to claim our costs from the client. Such conduct may also invalidate the insurance policy, so that the claimant would not be covered in the event of being ordered to pay the other side’s legal costs.
